India is the first country to incorporate protection of the environment as one of the fundamental duties of every citizen in its constitution under Article 48A. India is a mineral rich country. It has large reserves of coal, iron ore, bauxite, barytes, dolomite, manganese ore, mica, zircon, granite, marbel etc. Environmental laws play crucial preventive as well as remedial roles and are prime catalysts for promoting environmentally responsible behaviour. there has been a proliferation of Environmental laws in India after the Stockhomm Conference on Human Environment in June 1992. The Mining industry in India has been progressing at an annual rate of 4 to 5% during last three decades. A large population of mine workers, particularly those working in aged mine fields and in the unorganized sector living close to the mines, are exposed to the degreaded and polluted environment both on-site and off-side. Prolonged exposure gives rise to different diseases and poses health problem. The general people in the area are affected by the overall environment of the mining area itself. The present paper focuses on the prevailing lacunae in environmental legislations with respect to mining and also provide some suggestions regarding its modifications.
